Terms of service
These terms are the agreement between you and AuraScale about using Design Pilot. By signing in to Design Pilot or using it, you accept them. If you use Design Pilot for a company, you accept them for that company and say you can do so.
How we handle your information is in the privacy policy. It is part of these terms.
1. Who we are and what Design Pilot is
Design Pilot is made and run by AuraScale. In these terms, "we" and "us" mean AuraScale. "You" means the person who uses Design Pilot and, if you use it for a company, that company.
Design Pilot has two parts: a desktop app for Mac and Windows, and an online service at api.dpilot.dev that stores accounts, teams and projects and keeps everyone on a project in sync. The privacy policy describes both.
Design Pilot is in a private pilot. Features, limits and prices can change as it develops (section 9).
2. Accounts and teams
- You sign in with a Google account. You are responsible for that account and for what is done with it in Design Pilot. Do not share your sign-in.
- You must be at least 16.
- Work in Design Pilot belongs to a team. The first time you sign in, we create a free team for you, unless your company has a team you can join.
- Each person in a team has a role (owner, admin or member) and a seat (Full or Collab). The role decides what you can manage. The seat decides what you can do with designs.
- Team owners and admins can invite and remove people, change roles and seats, and manage billing. They can see every project in the team.
- An invitation is an offer. It adds no one until that person accepts it while signed in with the invited email address. Invitations expire after 7 days.
- If you invite someone, you say you may invite them. If you remove someone, their access to the team's projects ends.
- The team owner is responsible for the team's use of Design Pilot, including what the other people in the team do.
3. Acceptable use
Use Design Pilot only for lawful work. Do not:
- upload or create content that is illegal, or that you have no right to use;
- try to see another team's projects, files, names or email addresses, or get around any limit, seat or permission;
- probe, scan or test the service for weaknesses without our written permission, or interfere with how it runs;
- upload malware, or use Design Pilot to attack other systems;
- send invitations or emails through Design Pilot to people who do not expect them;
- use Design Pilot in a way that breaks the terms of Google, Polar or the provider of your AI tool;
- copy, resell or run the service for others as your own.
4. Your content
Your content is everything you or your team put into Design Pilot: projects, screens, styles, images, context files, Google Drive copies, AI chat, library items and the files that AI tools create from them.
- You own your content. These terms give us no ownership of it.
- You give AuraScale the right to store, copy, display and process your content, and to send it to our service providers, only as needed to run Design Pilot for you, as the privacy policy describes. Providing the service means keeping everyone on a project in sync, keeping checkpoints, and showing and sending content to the people you chose.
- You say that you have the right to put your content in Design Pilot and to let your team and your chosen AI tool use it. This includes client documents, brand materials and Google Drive files.
- You are responsible for your content, and for who in your team can see it. Everyone who can open a project can open its context files.
- You can delete content and projects. Deleted projects are removed for good after 30 days, as the privacy policy says. For a copy of your data, email us (section 13).
5. AI features
- Design Pilot does not include an AI model. The app starts an AI coding tool, such as Claude Code, that you have installed and signed in to yourself, on your own computer.
- You use that tool with your own account and your own subscription. Its provider's terms, prices, limits and privacy policy apply to your use of it. We are not a party to that agreement and are not responsible for the provider or its charges.
- When you start a run, the AI tool sends your instruction and the files the run may read, including context files with "AI can use" switched on, to its provider. Turn the switch off for any file that should not be sent. Do not let a tool read content that you may not share with its provider.
- AI output can be wrong, incomplete, out of date or similar to someone else's work. It can also change or delete files in the project. Design Pilot saves a checkpoint before and after every run, so you can go back, but you must check the result yourself.
- You review every AI result before you use it, share it or build from it. You are responsible for how you use it. AuraScale does not check AI output for accuracy, safety, accessibility, or rights of others.
- As between you and AuraScale, the prototypes and files your team makes with the AI tool are your content.
6. Google Drive files
Linking Google Drive files is optional. The privacy policy explains in full what we read, store and share (section 4 of the policy). In short:
- Design Pilot gets access only to the files you pick in Google's file picker, through Google's
drive.filepermission. - For each file you pick, we store a copy in the project and check it every hour and before each AI run, using your Google permission.
- Everyone on the project can open the copy, including people who cannot open the file in Drive. The app warns you before you link a file like that. Only link files you may share with your team.
- The copy can be read by an AI tool that a project member runs, as section 5 says.
- You can disconnect Google Drive at any time, in Project settings, Context files. You can also remove Design Pilot's access in your Google Account. Copies already in projects stay until someone removes them.
Your use of Google services is also covered by Google's own terms. Design Pilot's use of information from Google APIs follows the Google API Services User Data Policy, including the Limited Use requirements.
7. Fees and billing
Plans
- There are two plans: Starter, which is free, and Professional, which is paid. The app shows each plan's limits and prices before you pay.
- Professional is charged per Full seat, monthly or yearly. Collab seats on Professional are free. Prices are in US dollars.
- A team can start one 14-day trial of Professional without a card. Each person gets one trial, counted on the team owner. When the trial ends and the team has not subscribed, it returns to Starter.
Who sells it
- Paid plans are sold through Polar (polar.sh), which is the merchant of record. Polar charges your card, collects and pays sales tax and VAT where they apply, issues receipts and runs the customer portal. Prices shown before checkout do not include tax. Tax is added where it applies.
- Polar's own terms and privacy policy apply to your payment. We never see your card number.
- Only a team admin can start checkout, add seats or manage payment.
Charges and changes
- Subscriptions renew each month or year until canceled.
- When you add a Full seat in the middle of a period, the app shows the amount first. It is charged when you confirm. The charge covers the rest of the current period.
- When you lower the number of paid seats, the change applies at the next renewal. There is no credit for the current period.
- You can cancel at any time in the payment portal that Manage payment opens. The team keeps Professional until the end of the period it has paid for.
- If a payment fails, the team keeps Professional for now and the app shows a banner. If Polar ends the subscription after failed payments, the team returns to Starter.
- Refunds: payments are handled by Polar, and refunds follow Polar's refund process. We do not refund part of a billing period you have already started.
- If we change a price, it applies from your next renewal. We will tell you at least 30 days before it applies.
When a team goes back to Starter
Nothing is deleted. Projects, files and checkpoints stay. Anything over the Starter limits becomes read-only until the team is within the limits or upgrades.
8. Suspension and ending your use
- You can stop using Design Pilot at any time. A team owner can delete the team in Team settings. To delete your account, email us (section 13).
- We can suspend or end your access if you break these terms, if your use puts the service, other people or the law at risk, or if you do not pay. Where we reasonably can, we will tell you why and give you time to fix it first.
- We can end the service or a part of it. If we do, we will tell you in the app or by email at least 30 days before it ends and give you the chance to take a copy of your content.
- When your access ends, we delete your content as the privacy policy describes. Sections 4 (ownership), 10, 11, 12 and any money already owed stay in force.
9. Changes
We can change Design Pilot and these terms. If we change the terms, we will post the new version on this page with a new effective date. If a change matters to you, we will tell you in the app or by email at least 30 days before it applies. If you keep using Design Pilot after the date, you accept the new terms. If you do not accept them, stop using Design Pilot and tell us.
A change to how we use Google user data follows section 15 of the privacy policy.
10. No warranty
Design Pilot is a pilot product. We provide it "as is" and "as available". We do not promise that it will be error-free, always available, or free of loss of data, and we do not promise that AI output, or anything made with it, will be correct or fit for your purpose. We give no implied warranties, including of merchantability, fitness for a particular purpose and non-infringement, as far as the law allows. Keep your own copies of work you cannot lose.
Google, Cloudflare, Polar and AI providers are separate companies. We are not responsible for their services.
11. Limit of liability
As far as the law allows:
- AuraScale is not liable for lost profits, lost revenue, lost data, or any indirect, special or consequential damages that come from your use of Design Pilot, even if we were told they could happen.
- AuraScale's total liability to you for all claims about Design Pilot is limited to the amount your team paid AuraScale for Design Pilot in the 12 months before the claim. If your team paid nothing, the limit is US$100.
Nothing in these terms limits liability that the law does not allow to be limited, such as liability for fraud or for death or personal injury caused by negligence. You are responsible for claims that come from your content or from your breach of section 3.
12. Governing law
These terms are governed by the laws of the State of Delaware, USA. Disputes go to the state and federal courts located in Delaware, unless the law of where you live gives you the right to use your local courts.
